PHILADELPHIA, PA (September 21, 2023) – Today, Firearms Policy Coalition (FPC) announced the filing of a reply brief with the Third Circuit Court of Appeals in its Gray v. Jennings and Graham v. Jennings lawsuits, which challenge Delaware’s “assault weapon” and standard capacity magazine bans, respectively. The brief can be viewed at FPCLegal.org.

“Delaware’s law banning firearms and ammunition magazines possessed by millions of Americans is flagrantly unconstitutional,” argues the brief. “Under binding Supreme Court precedent, the law-abiding citizens of this country have an absolute right to possess arms that are in common use. Arms possessed by millions easily meet that description.”

“Delaware’s ban is not just unconstitutional, but immoral and offensive–it is nothing more than politicians denying to the people access to the very arms that those politicians demand for their own protection,” said Cody J. Wisniewski, FPC Action Foundation’s General Counsel and Vice President of Legal, and FPC’s counsel. “Delaware does not have the power to tread upon the constitutionally protected rights of peaceable people and has no business denying those individuals the right to choose the tools they deem necessary for their own defense.”
