LAS VEGAS (September 5, 2025) — Firearms Policy Coalition (FPC) issued the following statement regarding recent media reports suggesting that Department of Justice (DOJ) officials may be considering policies to restrict the right of entire classes of people to keep and bear arms:
Federal statutes and binding Supreme Court precedent make clear that the government cannot impose a categorical ban on an entire class of peaceable people. Under 18 U.S.C. § 922, firearm possession may only be prohibited for certain individuals—such as those adjudicated as a “mental defective” or “committed to a mental institution”—and both require individualized findings.
In United States v. Rahimi (2024), the Supreme Court concluded that an “individual found by a court to pose a credible threat to the physical safety of another may be temporarily disarmed consistent with the Second Amendment.” That holding is expressly limited: it applies only to individuals adjudicated by a court, only upon findings of a credible threat to another’s safety, and even then, only allows for temporary disarmament. The Court emphasized that the Nation’s tradition permits disarming those who present such a threat — not entire groups.
Our purpose is to create a world of maximal human liberty and end government coercion that separates peaceable people from their life, liberty, and property. And achieving our current mission requires us to eliminate bans on constitutionally protected arms, carry in public, the personal manufacture of weapons, and non-dangerous legal adults.
If the Trump Administration — or any administration — unwisely and immorally chooses to wield the force of government in conflict with the Constitution, federal law, or our values, FPC will take aggressive action to defend the rights of peaceable people, just as we have many times before.
