SAN DIEGO, CA (September 18, 2023) – Today, Firearms Policy Coalition (FPC) announced that it has filed a renewed motion for summary judgment in its Nguyen v. Bonta lawsuit, which challenges California's ban on purchasing more than one handgun or semiautomatic, centerfire rifle in a 30-day period. The motion and supporting papers can be viewed at FPCLaw.org.

“As Plaintiffs have already explained, the fate of the [one-gun-per-month] law was sealed under District of Columbia v. Heller, even under the ‘means-end scrutiny’ standards squarely rejected in Bruen as insufficiently protective,” argues the motion. “Now, with such artificial barriers out of the way, the path to judgment in Plaintiffs’ favor is even clearer.”

“California’s law is just another means by which the state infringes on the rights of its residents while trying to skirt the edges of existing precedent,” said Cody J. Wisniewski, FPC Action Foundation’s General Counsel and Vice President of Legal and FPC’s counsel. “But the fact of the matter is that California’s law violates the Second Amendment and runs afoul of Supreme Court precedent. The law is unconstitutional, and we look forward to the Court finding as much.”

FPC is joined in the litigation by San Diego County Gun Owners PAC and Second Amendment Foundation.
