ST. LOUIS,  MO (July 16, 2024) – Today, Firearms Policy Coalition (FPC) announced a major victory at the Eighth Circuit Court of Appeals in Worth v. Jacobson, its federal Second Amendment challenge to Minnesota’s ban on carry for 18–to–20–year–olds, where the court unanimously affirmed a decision that the State’s ban is unconstitutional. “This decision confirms that age-based firearm bans are flatly unconstitutional. All peaceable people have a natural right to carry firearms in public, and adults under the age of 21 are no exception,” said FPC President Brandon Combs. “Securing the right to keep and bear arms for all peaceable people is a key element of our high-impact strategy. This case is another example of our work and the truth prevailing over tyrants and their pet gun control advocacy organizations like Everytown. We look forward to continuing our successful work to create maximal liberty throughout the United States.”

“Minnesota has not met its burden to proffer sufficient evidence to rebut the presumption that 18 to 20-year-olds seeking to carry handguns in public for self-defense are protected by the right to keep and bear arms,” the court stated in its unanimous decision. “The Carry Ban…violates the Second Amendment as applied to Minnesota through the Fourteenth Amendment, and, thus, is unconstitutional.”

This challenge was brought as part of FPC’s high-impact FPC Law strategic litigation program to eliminate disarmament regimes and restore the natural right to keep and bear arms.
