Update in Massachusetts Roster Case in Today's FPC Daily 2A Legal Update
8/20/21
In today's FPC legal update, we have an update from FPC lawsuit challenging the Massachusetts' Approved Handgun Roster and Attorney General's Handgun Sales Regulations.
Issue: Handgun roster
Court: District of Massachusetts
Action: Motion to Dismiss
Massachusetts filed a motion to dismiss today in a lawsuit challenging the state's Approved Handgun Roster and Attorney General's Handgun Sales Regulations. The motion argues that the judge should dismiss the lawsuit against it, saying that "there are hundreds of handgun models that Plaintiffs can lawfully buy in Massachusetts," and that "some states required that firearms pass safety and quality inspections" in the early 19th century. In addition, the motion argues that "even assuming that the handgun safety regulations touch upon Second Amendment rights, they do not impose a substantial burden on those rights and easily survive intermediate scrutiny." The plaintiffs will now have an opportunity to respond to the motion.
