Summary: SB 1038 would create a statewide list of persons prohibited from owning a firearm. Like other lists we’ve seen implemented by the government, the “no-gun” list created by SB 1038 would be rife for abuse and error that would result in law-abiding people having their Second Amendment rights stripped from them. SB 1038 would also punish the sale of ammunition to any person on the “no-gun” list with no indication of whether failure by the “no-gun” list is a justified defense.
