WASHINGTON (January 19, 2024) – Today, Firearms Policy Coalition (FPC) announced the filing of a brief with the United States Supreme Court in support of the NRA’s First Amendment lawsuit against the former Superintendent of New York’s Department of Financial Services (DFS). The brief in NRA v. Vullo can be viewed at FPCLaw.org.

“It is no accident that this issue has arisen in the context of an organization advocating for Second Amendment rights,” argues the brief. “Vullo is not the first politician with apparent disdain for the people’s right to keep and bear arms and she will not be the last. But tactics like hers have spread and will continue to do so if this Court does not send a strong message that the First Amendment rights of organizations promoting the right to keep and bear arms are just as protected as anyone else’s.”

“Not being content with its draconian laws aimed at disarming its residents, New York has pursued a series of collateral attacks designed to undermine the pro-rights and pro-gun movement,” said Cody J. Wisniewski, FPC Action Foundation’s Vice President and General Counsel, and counsel for FPC. “In this brief, FPC highlights not just the First Amendment violations perpetrated by New York officials, but also the actions of several jurisdictions aimed at undermining individual rights–especially the natural right to armed self-defense.”

FPC's brief was filed by attorneys David H. Thompson, Peter A. Patterson, and William V. Bergstrom of Cooper & Kirk, PLLC.
