Update in New Hawaii Lawsuit in Today's FPC Daily 2A Legal Update

In today's FPC legal update, we have an update from a new lawsuit in Hawaii.


Roa v. Honolulu

Issue: Prohibited persons

Court: District of Hawaii

Action: Complaint, Motion for preliminary injunction

Under Hawaii law, people convicted of a "crime of violence" are banned from having gun licenses. However, the plaintiffs in this new lawsuit claim that Honolulu is considering disorderly conduct a "crime of violence," even if the conviction was for a "violation" (which isn't considered a crime, let alone a violent one.) The plaintiffs also filed a motion for a preliminary injunction, which asks the court to stop the city from enforcing its policy while the lawsuit continues. The city will now have an opportunity to respond to the complaint and the motion.
