Today, a 9th Circuit Court of Appeals panel decided 2-1 that the Second Amendment extends beyond the home.

The majority opinion was written by Judge Diarmuid O’Scannlain (appointed by Reagan) and joined by Judge Ikuta (appointed by George W. Bush). Judge Clifton (appointed by George W. Bush) dissented.

Previously, Judge O’Scannlain wrote the pro-2A Nordyke, Peruta/Richards, and Teixeira decisions.

Given the history, we expect the County of Hawaii to petition for en banc rehearing; it is also possible that the Court orders such rehearing sua sponte.
