Bill - S 394: Protect Our Military Families' 2nd Amendment Rights Act
- See similar bill HR 256.
- Position: Strongly Support
- Sponsor: Sen. Mike Rounds (R-SD)
Under current law, Americans can only purchase a handgun in the state where they are considered residents. Exceptions are made for members of the military, but not their spouses.
The Protect Our Military Families' 2nd Amendment Rights Act would allow the spouses of active duty service members to purchase firearms in the state where they are actually living due to military orders, rather than only in the state in which they have a official residence.
In the modern era, with electronic background checks, there is little reason to deny a law-abiding American access to an enumerated right based on their residency, let alone those who may change that residency frequently based on their marriage to a member of the U.S. Armed Forces.
