S.3118 would establish the requirement that mens rea (a.k.a. a state of mind or intent/knowledge of wrongdoing) be specified for each criminal statutory and regulatory offense at the federal level. Many existing offenses lack mens rea standards, meaning the intent of an individual is irrelevant when proving guilt. In other words, innocent mistakes and accidents could become crimes in the current system.
Additionally, S.3118 would require the formation of a bipartisan commission that evaluates, reports on, and makes recommendations related to the criminal justice system in its current form.
This carefully crafted bill addresses the flawed criminal justice system and would result in the implementation of effective and necessary solutions that are desperately needed and long overdue.
