Summary: Adds Negative Provisions to Existing Red Flag Laws

If passed, NM HB 193 would add police officers as reporting parties under New Mexico’s red flag law. The bill would also require police to seize all firearms that are specifically subject to red flag “protective orders, in addition to any firearms that are in plain sight, or any “discovered pursuant to a lawful search.” This would include firearms that aren’t even owned by the person who is subject to the order.

In addition to permitting unconstitutional seizure of firearms, HB 193 would require the courts to inform NICS if any ERPO is issued or extended within 24 hours. While the bill provides that the courts would also have to inform them of orders that have been “dissolved” or terminated, clerical errors could result in indefinite suspension of law-abiding New Mexicans from their right to keep and bear arms. 

HB 193 takes an already unconstitutional red flag law and makes it worse.
