“By arguing that the Roster features ‘hundreds’ of unique handguns, the State is essentially gaslighting California gun owners,” said FPC Policy Director Richard Thomson. “Indeed, our research shows that there are hundreds of duplicate firearms on the Roster, many of which are only differentiated from one another based on aesthetic features like color. This is beyond absurd, and it shows why the Roster must be overturned.”

“This is a strong indicator that Mr. Barr, if confirmed, would not only maintain the DOJ’s troubling current litigation positions, but potentially even direct United States Attorneys and DOJ civil litigation counsel across the nation to take even more aggressively anti-rights, authoritarian positions in a wide variety of prosecutions and constitutional challenges. That is not the proper remedy for centuries of constitutional resistance and atrophy,” said the constitutional rights advocacy group.

A brief supporting Supreme Court review of a Fifth Circuit decision in a Second Amendment challenge to irrational federal gun control rules was filed by civil rights attorney Donald J. Kilmer, reports three constitutional rights advocacy groups who joined the brief.

Counsel for two individual California residents and five constitutional rights advocacy groups filed a federal lawsuit challenging the State’s laws and policies that, they claim, prevent people from exercising their Second Amendment rights. Named defendants in the lawsuit include Becerra, DOJ Bureau of Firearms Chief Martin Horan, and Deputy Attorney General Robert Wilson. Attorneys for an owner of a “bump-stock” device and three advocacy organizations filed a federal lawsuit against the Trump Administration’s new rule that bans the firearm parts. A copy of the court filings can be viewed at www.bumpstockcase.com. The plaintiffs also filed a motion seeking a temporary injunction to prevent the Trump Administration from implementing and enforcing the new regulation.

In the latest complaint, submitted last Friday, the plaintiffs added a claim for deprivation of their due process rights under Title 42, Section 1983 of the United States Code. The plaintiffs said that they would soon be asking Judge England for a preliminary injunction to protect affected gun owners’ rights and property while the case goes forward to summary judgement or trial.
