SAN DIEGO, CA (August 30, 2022) – Today, Firearms Policy Coalition (FPC) announced the filing of a supplemental brief in its Miller v. Bonta lawsuit, which challenges California’s ban on so-called “assault weapons.” The brief, which was requested by Judge Roger Benitez of the Southern District of California after the Ninth Circuit vacated and remanded Miller in light of NYSRPA v. Bruen, can be viewed at FPCLegal.org.

“In its prior opinion in this case, the Court concluded that the banned arms are ‘very popular hardware—firearms that are lawful under federal law and under the laws of most states and that are commonly held by law-abiding citizens for lawful purposes,’” says the brief. “Accordingly, all that is left for this Court to do is reinstitute its decision finding California’s ban unconstitutional under the legal principles confirmed by Bruen.”

“FPC is looking forward to a swift decision on the merits of this case,” said FPC Director of Legal Operations Bill Sack. “The District Court already issued a well reasoned decision in this case applying what has now been affirmed in Bruen as the correct analysis in Second Amendment matters. The underlying historical record hasn’t changed since then, and neither should the outcome of this case.”

Following the submission of the supplemental briefs, the Court requested additional briefs from the parties in light of Bruen. The additional briefs are due in 45 days, with response briefs due 15 days after that.
