Updates in Lawsuit Challenging New Jersey's Firearm Purchase Permit Requirements in Today's FPC Daily 2A Legal Update

In today's FPC legal update, we have two new filings from a lawsuit challenging New Jersey's Firearm Purchase Permit requirements.

Action: Ronald A. Cundey and John Polillo Motion to Dismiss, Gurbir S. Grewal and Patrick J. Callahan’s Motion to Dismiss

Motions to dismiss were filed by the defendants in the FPC lawsuit Kendrick v. Grewal, which challenges New Jersey’s laws requiring individuals to be granted a permit before acquiring a rifle, shotgun, or handgun. A motion to dismiss is a legal filing that asks the court to remove the filing party from the lawsuit. The first motion to dismiss, filed by two municipal police chiefs, argues that "[n]o municipal ordinances, rules or regulations are identified as the source for any grievance by the Plaintiff," and therefore they should be removed from the lawsuit. The second motion to dismiss, filed by the state Attorney General and the Superintendent of State Police, argues that the lawsuit should be dismissed because the plaintiffs "do not even allege an intent to apply for either permit... Nor do the Individual Plaintiffs allege that applying for either permit would somehow be futile."
