BALTIMORE, MD (May 16, 2023) – On the same day it secured a preliminary injunction against numerous restrictions on the right to bear arms in New Jersey, Firearms Policy Coalition (FPC) announced the filing of a new Second Amendment challenge in Maryland. The new lawsuit challenges multiple elements of the state’s Senate Bill 1 (SB 1) restrictions on the peaceable carry of firearms outside the home, which was signed into law today. The complaint in FPC’s Novotny v. Moore can be viewed at FPCLaw.org.

“SB1 was enacted for the avowed purpose of responding to the Supreme Court’s decision in New York State Rifle Pistol Association v. Bruen, 142 S.Ct. 2111 (2022), by restricting the locations that persons with Maryland wear and carry permits may legally exercise their constitutional right to wear, carry, or transport firearms,” the complaint states. “It does so in ways that are fundamentally inconsistent with the Second Amendment as clearly articulated in the Supreme Court’s decision in Bruen.”

“Apparently dissatisfied with last year's Bruen decision, and undeterred by their own oaths of office to uphold the Constitution, Maryland lawmakers have seen fit to once again attempt to unilaterally disarm the peaceable People of their state,” said Bill Sack, FPC Director of Legal Operations. “And so, once again, FPC, along with our great partners at Maryland Shall Issue and Second Amendment Foundation will meet them at the courthouse steps with a clear message: The rights of the people are not negotiable.”

FPC is joined in the litigation by Maryland Shall Issue and the Second Amendment Foundation.
